OVERVIEW
Stopbadcheck.com (SBC) merely provides an online platform to Check Cashers (referred as Clients hereinafter) for the purpose of preventing fraud through effectively and efficiently networking. SBC depends on its clients to input accurate data, however SBC does not and cannot verify its accuracy and therefore cannot warrant its accuracy.
SBC Conditional Use
Clients hereby acknowledge that they understand that the information provided in SBC is Non-Public Information (NPI) and therefore it should strictly be used for the sole purpose of preventing fraud in their establishment (establishment refers to the sole business location for which you have signed-up excluding their affiliation). In other words, the client cannot randomly check information about any individual unless that individual has come to your establishment to cash a check. Similarly, the client cannot randomly check on any company, unless a customer has presented the check for which the particular company/individual is a maker.
Clients hereby acknowledge that they would not share or disclose NPI to any other establishment, entity, organization or third party affiliate. They also acknowledge that they cannot use the NPI for any other purpose, except for the purpose of preventing fraud in their establishment, as mentioned in the previous paragraph.
Due to the sensitivity of the data provided by SBC, only the clients (here the word clients(“clients” refers to a person or persons who are the stakeholder(s) in the entity/business establishment which perform check-cashing) who does not have any criminal history are eligible to sign-up for SBC. Therefore, by signing up for SBC they acknowledge & declare that they don’t have any criminal history whatsoever. They further acknowledge that they are licensed by the government agency or agencies to conduct check cashing activity in their establishment. It is the client’s responsibility to unsubscribe themselves ( including the users within their account ) from SBC, shall their government license for conducting check-cashing is suspended, revoked, canceled, expired, or other they become ineligible due to any criminal charges or conviction. In addition, the clients acknowledge that they are abiding and would continue to abide by all the government rules, regulations and laws pertaining to check cashing in their establishment, including providing the access to SBC to its various employees through their account. As SBC contains NPI, the client acknowledges that they would not provide access of SBC to any employee with a criminal history.
All data provided by the clients and its users become the property of SBC. It is the responsibility of the client to ensure that any data entered by them in SBC is accurate, authentic and legitimate. Accuracy is even more critical when entering a bounce check/decline check/network remark as it may potentially prevent a customer from cashing check in the entire network. All data provided by the clients and its users becomes the property of SBC. Client also indemnifies and holds SBC harmless against any incorrect information.
Service by SBC
SBC being an online platform depends on various external elements such as web hosting, internet connectivity, etc. In the event if SBC service is disrupted due to any such reason (apart from reasons related to client’s side), than the sole liability of SBC is to give prorated credit based on the monthly fees to its clients for the period of such interruptions. So if the service is down for a day, than the client shall receive credit which is equal to 1/30th times the monthly bill.
SBC Rights
SBC has the right to terminate any client if it determines that the client is unnecessarily trying to derive NPI (non-public information) or is using SBC other than the purpose of what it is designed for, to prevent fraud. It is solely upto SBC’s discretion, whether it chooses to give any advance notification or not, before terminating the client’s account(s) in case of such determination.
